THE IMPACT OF LITIGIOUSNESS
The pervasiveness of litigation
in our culture is a form of pollution that threatens the quality of life
for us all. It promotes an atmosphere of paranoia and creates mounds
of paperwork designed to document our actions. It also generates
an increasing number of regulations attempting to avoid the consequences
of lawsuits reoccurring, thereby adding to the complicated laws governing
our daily lives.
There are times when a lawsuit is
the most effective method for setting things right. But all too often,
lawsuits are misdeeds, in and of themselves. They can invade people’s
privacy, incur insurmountable debt for the participants, take up tremendous
amounts of time and involve calculated or vengeful dishonesty. The emotional fallout of being falsely accused, much less convicted, can be devastating. Lawsuits can also be
indicative of a lack of forgiveness and generosity, as well as holding
people hostage to their past mistakes.
Lawsuits typically involve intimidating
depositions, cross-complaints, interrogatories, discoveries and other copious
amounts of paper, much of which is never referred to again, but copied
many times over for all parties concerned. Many trees die in service
to these wars waged on paper.
